Platform Overview

Welcome to JurnAI! Our platform enables users to journal and receive AI-powered insights about their behavioral patterns and habits. By using our platform, you agree to these Terms of Service, which constitute a legally binding agreement between you and JurnAI.

1. Who You Are Contracting With

If you live in:

• European Economic Area (EEA), UK or Switzerland: These Terms are between you and JurnAI Technologies Ltd, 10 Farringdon Road, London, EC1M 3HF, United Kingdom.
• United States or elsewhere: These Terms are between you and JurnAI Corp., 200 Park Ave, New York, NY 10166, USA.

References to "JurnAI", "we", or "us" refer to the entity above based on your residence.

2. Eligibility

You are not permitted to use JurnAI unless all of the following are true:

• You are at least 18 years old;
• You are not prohibited by law from using our Service;
• You are not listed on any government restricted parties list;
• You do not have more than one account on JurnAI;
• You have not previously been removed or banned by JurnAI unless you have written authorization to rejoin.

If any of these requirements cease to apply, you must delete your account.

3. Account Registration

To use JurnAI, you must create an account by providing accurate and complete information. You are responsible for keeping your login credentials confidential and for all activity under your account.

4. User Conduct and Safety

We expect all users to engage responsibly with our platform. You agree not to:

• Violate any law or regulation;
• Use JurnAI for any illegal or unauthorized purpose;
• Post content that promotes harm to self or others;
• Use JurnAI for commercial purposes or spam;
• Impersonate anyone or misrepresent your identity;
• Create multiple or fake accounts;
• Attempt to bypass any filtering or security mechanisms.

Violation of these rules may result in account suspension or permanent ban.

5. Fees and Payments

Some features of our platform may require payment. Fees are billed on a regular and recurring basis unless you disable auto-renewal or cancel your subscription. Refunds are subject to our refund policy.

6. User Content and Privacy

You are responsible for the content you post on our platform. By submitting journal entries, you grant us a license to use it to operate, improve, and promote our platform, as well as to analyze the content using AI to provide insights. 7. Dispute Resolution

In the event of a dispute, we encourage you to contact us to resolve the issue amicably. If necessary, disputes will be resolved through binding arbitration, and you waive your right to a jury trial or class action.

8. AI Analysis

JurnAI provides AI-powered insights based on your journal entries. These insights are generated by sending your journal content to OpenAI for analysis. While we strive for accuracy, the AI analysis should be considered informational and not as professional advice. Always consult appropriate professionals for health, mental health, or other important decisions.

9. Subscription Terms (Apple Pay)

JurnAI offers paid subscriptions processed through Apple Pay. By subscribing:

• You agree to auto-renewal unless cancelled through your Apple ID;
• Refunds are handled by Apple, not JurnAI;
• Promotional pricing may vary by user and region;
• EU/UK users have a 14-day right to cancel and request a full refund;
• California residents may cancel within 3 business days by writing to: JurnAI Cancellations, 200 Park Ave, New York, NY 10166, USA.

10. Content Ownership and Licensing

You retain rights to the journal content you create but grant JurnAI a perpetual, worldwide, royalty-free license to host, analyze, process, and use such content to operate the Service and provide insights. This includes sharing your content with OpenAI for analysis purposes.

11. Termination

We may suspend or terminate your account at any time if you violate these Terms. You can delete your account via app settings.

12. Disclaimers

JurnAI provides the Service "as is." We disclaim all warranties including merchantability and fitness for a particular purpose. The AI insights provided should not be considered professional advice.

13. Limitation of Liability

To the maximum extent permitted by law, JurnAI will not be liable for indirect, incidental, or consequential damages. Our total liability will not exceed the greater of $100 or the total amount paid by you in the last 12 months.

14. Privacy and Data Protection

We are committed to protecting your privacy. Please review our Privacy Policy for details on how we collect, use, and protect your information.

15. Intellectual Property

All content, trademarks, and data on this site, including but not limited to software, databases, text, graphics, icons, hyperlinks, private information, designs, and agreements, are the property of or licensed to JurnAI and as such are protected from infringement by local and international legislation and treaties. Subject to the rights afforded to you herein, all other rights to all intellectual property on this site are expressly reserved.

16. Data and AI Training

We may use anonymized data from journal entries to improve our AI models and enhance the quality of insights provided. This data is stripped of personal identifiers before being used for training purposes. You can opt out of having your data used for training by contacting us.

17. Amendments

We may update these Terms from time to time to reflect changes in our practices or the law. We will notify you of any significant changes by posting the new Terms on our site. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

18. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which you reside, without regard to its conflict of law principles.
